1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the website Power BI Studio available at https://powerbistudio.com/ and all related tools, features, content, and services (collectively, the "Platform").

The Platform is owned and operated by Mohd Ayan Khan, an individual and sole owner of Power BI Studio ("Owner", "we", "us", or "our"). By accessing or using the Platform, you ("user", "you", or "your") agree that you are entering into a legally binding agreement with the Owner under the Indian Contract Act, 1872 and the Information Technology Act, 2000, along with applicable rules and guidelines.

2. Acceptance of Terms

By accessing, browsing, registering an account, or using any feature of the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must immediately stop using the Platform and any related services. Your continued use of the Platform after any update to these Terms will be deemed acceptance of the revised Terms.

3. Eligibility and User Account

You must be at least 18 years of age and capable of entering into a legally binding contract under Indian law to use the Platform or create an account.

You agree to provide true, accurate, current, and complete information when creating your account and to keep such information updated at all times. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities undertaken under your account. Sharing login credentials or allowing multiple individuals to use a single account is strictly prohibited unless expressly permitted under a specific plan.

You must notify us immediately at support@powerbistudio.com if you suspect any unauthorized access, use, or security breach related to your account.

4. Nature of Services

Power BI Studio provides a suite of digital tools, including:

• Power BI theme and color palette generation.
• Image-based color extraction, where uploaded images are processed temporarily.
• URL-based palette extraction from third-party sources.
• AI-based color and theme generation using user prompts and inputs.
• User account features for saving palettes, using credits, and accessing membership-based features.
• Access to free and paid digital products, including Power BI templates, .pbix files, dashboards, and related resources.

No physical goods are sold or shipped; all offerings are digital in nature. The features and tools may be changed, suspended, or discontinued at any time, with or without prior notice, at the sole discretion of the Owner, subject to applicable law.

5. AI-Generated Output and Technical Limitations

Certain features on the Platform use artificial intelligence and automated algorithms to generate color palettes, Power BI themes, or other outputs based on your prompts, images, or inputs.

AI-generated output may be incomplete, inaccurate, unsuitable, biased, or may not work as expected in your specific Power BI or business environment. You are solely responsible for verifying and validating any output before using it in production or business-critical contexts.

The Platform does not provide professional advice (including legal or financial). Any output is for informational and design assistance purposes only and must not be treated as certified or guaranteed.

6. Image Uploads and URL-Based Processing

When you upload images for color extraction, such images are processed by the Platform or its third-party processors for the purpose of generating color palettes or themes.

Images are not intentionally stored beyond the period technically necessary for processing; however, temporary caching, logging, or backup may happen as part of system operations or third-party infrastructure.

When you provide URLs or third-party links (for example, palettes from other platforms), you represent that you have the right to use such content and that doing so does not violate any third-party rights or applicable laws. You must not upload or link to any content that is illegal, infringing, harmful, hateful, abusive, obscene, or otherwise objectionable under applicable Indian law.

7. Memberships, Credits, and Plans

The Platform may offer free access, paid plans, membership tiers, and a credit-based usage system that may limit or govern access to certain features, AI usage, downloads, or saved items.

The details of available plans, credits, usage limits, and pricing will be displayed on the Platform and may be updated from time to time at our discretion. Credits and memberships are personal to your account and may not be transferred, resold, or exchanged unless specifically permitted in writing.

The Owner reserves the right to modify, suspend, or discontinue any membership plan, credit structure, or feature, including free trials, prospectively, subject to applicable law. Reasonable efforts will be made to honour existing paid commitments or provide proportionate alternatives where required.

8. Digital Products and Compatibility

The Platform may offer downloadable digital products such as Power BI dashboards, templates, .pbix files, themes, and other related assets (collectively, "Digital Products").

Compatibility of Digital Products may depend on:

• Your version of Power BI or other software.
• Your operating system or hardware specifications.
• Your data model, configurations, and environment setup.

While reasonable efforts are made to describe compatibility requirements, no guarantee is given that any Digital Product will function without error or adjustment in your specific environment. You are solely responsible for verifying suitability and compatibility before applying Digital Products to production or client work.

9. Payments and Third-Party Gateways

Paid plans, credits, or Digital Products may be purchased through third-party payment gateways such as Razorpay, PayU, Stripe India, Cashfree, or similar providers, as may be integrated on the Platform from time to time.

The Platform does not store your complete card, UPI, or net banking details. Such payment information may be collected, processed, and stored by the relevant payment gateway in accordance with their own privacy and security practices. By making a payment, you agree to be bound by the terms and policies of the respective payment gateway, in addition to these Terms.

All prices, fees, and charges are displayed in the applicable currency on the Platform and may be changed prospectively at any time. Any applicable taxes and charges may be added as required by law.

10. Refunds, Cancellations, and Renewals

Refunds and cancellations for memberships, credits, or Digital Products are governed by the separate Refund & Cancellation Policy published on the Platform, which forms an integral part of these Terms.

Where subscriptions or memberships are set to auto-renew, you are responsible for managing your renewal preferences before the renewal date. Failure to cancel in time may result in automatic charges as per the selected plan.

11. Acceptable Use

You agree not to:

• Use the Platform for any illegal, fraudulent, or unauthorized purpose.
• Attempt to reverse engineer, decompile, or otherwise access the Platform's source code.
• Bypass or interfere with security-related features or usage limitations.
• Use bots, scripts, or automated tools to abuse credits or membership benefits.
• Infringe upon any intellectual property or other rights of the Owner or third parties.

The Owner reserves the right to suspend, restrict, or terminate your access if any prohibited or abusive conduct is detected, or if required by law or by payment partners.

12. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images (excluding user uploads), code, and design, is owned by or licensed to the Owner and is protected under applicable copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform and any Digital Products for your own internal or client work, unless a specific license states otherwise. Resale, redistribution, or public sharing of Digital Products without permission is prohibited.

13. Service Availability, Downtime, and Maintenance

The Platform and services are provided on an "as is" and "as available" basis, without any guarantee of uninterrupted, error-free, or always-available operation.

The Platform may be temporarily unavailable or degraded due to maintenance, upgrades, network issues, system failures, or circumstances beyond the control of the Owner, including third-party service disruptions. The Owner will not be liable for any loss, damage, or inconvenience caused by unavailability, delay, or technical issues of the Platform, to the maximum extent permitted by applicable law.

14. Data, Backups, and Loss

While reasonable technical measures may be used to protect your account and saved palettes or settings, there is no guarantee against data loss, corruption, or accidental deletion.

You are advised to maintain your own backups of any critical configurations, styles, or deliverables generated through the Platform. The Owner will not be liable for any loss of data, loss of business, lost profits, or other indirect or consequential loss arising from use or inability to use the Platform.

15. Limitation of Liability

To the fullest extent permitted by applicable law, the Owner's total aggregate liability for any claim arising out of or relating to the Platform, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you to the Owner for the services or Digital Products during the three (3) months immediately preceding the event giving rise to the claim.

In no event shall the Owner be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to business interruption, loss of profits, loss of data, or loss of reputation, even if advised of the possibility of such damages.

16. Indemnity

You agree to indemnify, defend, and hold harmless the Owner from any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use or misuse of the Platform, your violation of these Terms or any applicable law, or your infringement of any intellectual property or other rights of any third party.

17. Changes to Terms and Services

The Owner reserves the right to modify these Terms at any time by posting an updated version on the Platform. The updated Terms will be effective upon posting unless a later date is specified.

Your continued use of the Platform after such changes will constitute your acceptance of the revised Terms. If you do not agree, you must stop using the Platform.
